DMCA Policy

Cyborg Marketing LLC respects the intellectual property rights of others. This policy describes how to report alleged copyright infringement on cyborg.marketing under the Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512).

How to send a takedown notice

If you believe content on cyborg.marketing infringes a copyright you own or are authorized to enforce, send a written notice to our designated DMCA agent that includes:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
  2. Identification of the copyrighted work you claim is infringed, or a representative list of works if multiple works at a single site are covered.
  3. Identification of the material you claim is infringing, with enough detail (including the URL on cyborg.marketing) to allow us to locate it.
  4. Your contact information: name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that the contested use is not authorized by the copyright owner, the owner’s agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the right that is allegedly infringed.

Counter-notification

If you are the owner of content that has been removed or disabled in response to a DMCA notice and you believe the removal was a mistake, you may submit a counter-notification. Send a written counter-notification to our DMCA agent that includes:

  1. Your physical or electronic signature.
  2. Identification of the material removed and the URL it appeared at before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located.

False claims

Knowingly making a false claim in a DMCA notice or counter-notification can subject the sender to liability for damages under 17 U.S.C. § 512(f). Consult an attorney before submitting if you are not sure whether your claim is well founded.

Repeat infringers

Cyborg Marketing LLC will, in appropriate circumstances, terminate the accounts of users (including affiliates and partners) who are repeat copyright infringers.
